Child Custody & Visitation - Judicial Interview of Children in Florida
Where one party requests that a record be kept of the Court's in camera conversations with children or of the children's testimony, a court reporter shall be permitted to keep a record of the children's testimony or the children's in camera conversations with the Court. "Where neither of the parties requested that the court reporter record the child's testimony or in camera conversations with the court, there is no error in this not having been done. However, where one of the parties requests a record, the court errs in not having the court reporter in attendance to record the conversation or testimony." Hathcock v. Hathcock, 680 So.2d 564 (Fla. 1st DCA 1996); Hickey v. Burlinson,.
