Florida Law Concerning Alimony
In awarding alimony, some of the statutory factors that Florida Courts consider are:
- whether the recipient has an actual need for alimony, and whether the payor has the ability to pay alimony
- the standard of living that was established by the parties during their marriage and the anticipated needs and necessities of life for both of the parties after they are divorced
- the length of the parties’ marriage
- the age of each of the parties, and their physical, mental and emotional condition
- each party’s financial resources, including their income and marital and nonmarital and assets and liabilities
- each of the party’s earning capacities, and, if applicable, the time required for either of the parties to acquire sufficient training and education to find appropriate employment
- each party’s contribution to the marriage, including, without limitation, services rendered in childcare, education, homemaking, and career building
- each of the party’s responsibilities for their minor children after the conclusion of the dissolution proceedings
- any other factor that the court finds to be necessary to accomplish a fair and equitable result

Alimony - FAQs
In Florida, alimony refers to the financial support one spouse may be required to pay to the other after a divorce. The court decides on alimony based on specific rules and the facts of each case.
At the Lane Law Firm, we help clients understand how Florida’s alimony laws affect their cases. Here are some commonly asked questions about the legal process:
Florida courts first determine if one spouse truly needs financial support and if the other spouse can afford to pay support. If both conditions exist, the court looks at several factors to decide the amount and type of alimony.
These include the couple's lifestyle during the marriage, how long the marriage lasted, and each spouse's age and health. The court also considers each spouse’s actual income and ability to earn income, their contributions to the marriage, and the responsibility to care for any children that they may have.
Florida’s no-fault divorce law means misconduct rarely affects alimony unless it involves wasting money or financial wrongdoing.
Florida law includes several types of alimony to meet different needs.
Temporary alimony lasts only while the divorce case is ongoing.
Bridge-the-gap alimony helps a spouse adjust to single life and lasts no more than two years.
Rehabilitative alimony supports a spouse to gain education or job skills and typically lasts up to five years.
Durational alimony pays support for a set time based on the length of the marriage, with limits depending on whether the marriage was short, medium, or long term.
Lump-sum alimony is a one-time payment instead of regular support.
The length of the marriage plays a significant role in alimony decisions. For marriages under ten years, support usually comes as a bridge-the-gap or rehabilitative alimony. Marriages lasting ten to twenty years may result in durational or rehabilitative alimony.
For marriages over twenty years, courts may award durational alimony for up to seventy-five percent of the length of the marriage. The court reviews financial details and the roles each spouse played during the marriage to reach a fair result.
