If the obligor fails to demonstrate his or her income during the retroactive period, the Court shall apply the current child support guidelines to calculate retroactive child support payments. “In addition, the ALJ erred in using Finch’s current monthly income to compute the retroactive support obligation.

The use of current income is permissible when the obligor fails to demonstrate his or her actual income during the retroactive period. See § 61.30(17)(a), Fla. Stat. (2011) (providing that the ‘[f]ailure of the obligor to… demonstrate [his or her actual income] shall result in the court using the obligor’s income at the time of the hearing in computing child support for the retroactive period’).” Finch v. Dep’t of Revenue o/b/o John-Jules

Strategic Support for Retroactive Child Support Disputes

Retroactive child support can create major financial stress if not handled properly. When income records are missing or incomplete, courts apply current income levels to determine past obligations. This often leads to higher support payments than expected.

At Lane Law Firm, we assist clients in preparing accurate financial records and developing strong legal arguments. No matter if you're seeking retroactive support or defending against it, we guide you through the process and clarify what the court requires at every stage.

We represent high-income clients and parents involved in complex support disputes, with a focus on preserving your financial stability and protecting your legal rights. Our team reviews every financial detail and makes sure the court hears your side.

Know Your Rights Before You Pay or Pursue Back Support

Retroactive child support orders often catch parents off guard, especially when they stretch back several months or even years. Many parents are unaware that the court can calculate obligations from the date the child support petition was filed, or even earlier in some instances. If you are the paying parent, it is important to understand how this could impact your current financial plans. If you are the receiving parent, you should know what evidence the court will expect to see.

At Lane Law Firm, we take time to explain every step and protect our clients from unfair or unexpected outcomes. We know how to challenge retroactive claims that lack documentation and how to support valid claims with strong financial evidence.

Child support cases require a clear legal strategy, especially when retroactive payments are involved. Attorney Matthew Lane understands how Florida law applies to retroactive child support and how to defend your position with facts. Are you facing a child support issue involving missing records, disputed income, or unfair calculations? Our firm is prepared to assist you. Acting without legal guidance can result in costly mistakes.

Lane Law Firm works with parents in Palm Beach Gardens and surrounding areas. We offer premium legal services to clients who expect clarity, professionalism, and strong advocacy. Don’t wait for the court to make a decision without your input.
